Terms of Service

01What I do

Creative direction, brand and design, websites and ecommerce, photo and video content, music and sound, experiential and events, and AI consulting. Current offers and pricing live on each site and in your SOW.

02How a project starts

1. Intro call or message. We talk through what you need.
2. SOW. I send scope, deliverables, timeline and price. Your signature or a written “approved” by email makes it official.
3. Payment. The first payment starts the work and holds your spot on my calendar.
4. Delivery. I build, share progress, and hand off final files, access and training per the SOW.

Anything outside the SOW is a change. I’ll quote it before doing it.

03Payment

• Each SOW sets the payment schedule. Most projects are 50% to start and 50% on delivery. Smaller fixed packages are paid in full up front.
• Hourly and ongoing work is billed monthly for the hours used.
• Invoices are due within 7 days. If a payment is more than 14 days late, work pauses until it’s settled.
• Paid calls booked through Cal.com are charged at booking. Reschedule at least 24 hours out at no cost.

04Cancellations and refunds

• Before work starts (before the kickoff call, or within 3 business days of paying, whichever comes first): full refund.
• After work starts: under 25% of deliverables done, 50% back. 25 to 75% done, 25% back. Over 75% done, no refund and I finish the job.
• Anything already delivered is yours to keep either way.
• If I have to end a project (it’s outside what I do, the working relationship breaks down, or the request would break the law or these terms), I refund the unfinished portion within 14 days.

05Who owns what

• You own the final deliverables once they’re paid in full: designs, sites, code in your accounts, content, documentation, and systems built for your business.
• I keep my tools. My templates, frameworks, processes, and reusable code and components stay mine. You get a permanent license to use whatever is built into your deliverables.
• Third-party stuff (fonts, stock, music, plugins, software) comes with its own license. I’ll tell you what’s included and what you need to buy.
• Showing the work. I can show finished work in my portfolio and on social once it’s public. Say so in the SOW if a project needs to stay private, and it will.

06Confidentiality

Anything non-public you share with me stays between us and the services listed in the Privacy Policy. Need an NDA? Send it before kickoff and I’ll sign any reasonable one.

07AI in the work

I use AI tools, mainly Claude by Anthropic, to research, draft, build and automate. AI can get things wrong. I build in review steps, but you’re responsible for checking what goes out to your customers, patients or the public. I can’t promise any AI system will be error-free.

08Your part

Send content, feedback and approvals on time, and make sure you have the rights to anything you give me to use. Timelines move when inputs are late.

09Using the sites

The sites and their content are mine. Don’t copy them wholesale, scrape them, or use the contact form to spam. Case studies and client work shown belong to Rad Animal or the client.

10Limits

To the extent the law allows, my total liability on any claim is capped at what you paid me for that project in the 12 months before the claim. I’m not liable for indirect or consequential losses like lost profits or downtime. Work is delivered as described in the SOW, with no other warranties.

11Disputes

California law applies. If something goes wrong, we talk it through first. If that doesn’t fix it, it goes to binding arbitration in Los Angeles County, California.

12Changes

I may update these terms. The date at the top shows the latest version. Signed projects stay on the terms in place when you signed.
